referitoare la perspectivele în domeniul dreptului de autor în Uniunea Europeană<o:p></o:p>

– având în vedere articolul 14 și articolul 95 din Tratatul CE,<o:p></o:p>

– având în vedere articolul 27 din Declarația Universală a Drepturilor Omului a Organizației Națiunilor Unite,<o:p></o:p>

– având în vedere articolul 17 alineatul (2) din Carta drepturilor fundamentale a Uniunii Europene,<o:p></o:p>

– având în vedere raportul Comisiei din 30 noiembrie 2007 referitor la aplicarea Directivei 2001/29/CE privind armonizarea anumitor aspecte ale dreptului de autor și drepturilor conexe în societatea informațională (SEC(2007)1556),<o:p></o:p>

– având în vedere Cartea verde a Comisiei din 16 iulie 2008 privind dreptul de autor în economia cunoașterii (COM(2008)0466),<o:p></o:p>

– având în vedere Directiva 2001/29/CE a Parlamentului European și a Consiliului din 22 mai 2001 privind armonizarea anumitor aspecte ale dreptului de autor și ale drepturilor conexe în societatea informațională[1],<o:p></o:p>

– având în vedere Directiva 2004/48/CE a Parlamentului European și a Consiliului din 29 aprilie 2004 privind respectarea drepturilor de proprietate intelectuală[2] și declarația Comisiei privind articolul 2 din Directiva 2004/48/CE (2005/295)[3],<o:p></o:p>

– având în vedere Rezoluția sa din 25 septembrie 2008 privind gestiunea colectivă transfrontalieră a drepturilor de autor și a drepturilor conexe în serviciile legale de muzică on-line[4],<o:p></o:p>

– având în vedere Rezoluția sa din 15 ianuarie 2004 privind un cadru comunitar pentru societățile de gestiune colectivă în domeniul dreptului de autor și a drepturilor conexe[5], <o:p></o:p>

– având în vedere Recomandarea Comisiei 2005/737/CE din 18 mai 2005 privind gestiunea colectivă transfrontalieră a dreptului de autor și a drepturilor conexe în serviciile legale de muzică on-line[6],<o:p></o:p>

– având în vedere Comunicarea Comisiei din 16 aprilie 2004 privind gestiunea dreptului de autor și a drepturilor conexe pe piața internă (COM(2004)0261),<o:p></o:p>

– având în vedere Directiva 96/9/CE a Parlamentului European și a Consiliului din 11 martie 1996 privind protecția juridică a bazelor de date[7],<o:p></o:p>

– având în vedere Directiva 2006/116/CE a Parlamentului European și a Consiliului din 12 decembrie 2006 privind durata de protecție a dreptului de autor și a anumitor drepturi conexe[8],<o:p></o:p>

– având în vedere rezoluția din 27 septembrie 2007 intitulată „2010: Spre o bibliotecă digitală europeană”[9],<o:p></o:p>

– având în vedere articolul 45 din Regulamentul său de procedură,<o:p></o:p>

– având în vedere raportul Comisiei pentru afaceri juridice și avizul Comisiei pentru industrie, cercetare și energie, precum și cel al Comisiei pentru piața internă și protecția consumatorilor (A6 0017/2009),<o:p></o:p>

Dreptul de autor și societatea informațională<o:p></o:p>

1. reamintește că adoptarea Directivei 2001/29/CE era unul dintre obiectivele prioritare definite de Consiliul European de la Lisabona din 23 și 24 martie 2000, în cadrul procesului realizării unei economii competitive, dinamice și bazate pe cunoaștere;<o:p></o:p>

2. reamintește obligația Comunității Europene și a statelor membre de a respecta cadrul internațional care reglementează dreptul de autor, și anume articolul 9 alineatul (2) din Convenția de la Berna din 1886 pentru protecția operelor literare și artistice și articolul 13 din Acordul privind aspectele comerciale ale drepturilor de proprietate intelectuală, ai cărui termeni se regăsesc la articolul 5 alineatul (5) din Directiva 2001/29/CE;<o:p></o:p>

3. consideră că aplicarea acestei directive în diferitele state membre, precum și efectele acesteia asupra armonizării dreptului de autor sunt satisfăcătoare;<o:p></o:p>

4. subliniază faptul că raportul inițial al Comisiei menționat anterior privind aplicarea articolelor 5, 6 și 8 din Directiva 2001/29/CE nu permite o evaluare pertinentă, dată fiind transpunerea târzie de către statele membre și solicită, prin urmare, Comisiei, să își concentreze eforturile legate de punerea în aplicare în mod integral a Directivei 2001/29/CE sub toate aspectele sale și să asigure un echilibru între remunerarea titularilor dreptului de autor și diseminarea în beneficiul consumatorilor europeni;<o:p></o:p>

5. regretă faptul că, în raportul său, Comisia nu ia în considerare practicile legislative ale țărilor care au devenit membre ale Uniunii după adoptarea Directivei 2001/29/CE;<o:p></o:p>

6. recomandă Comisiei să își rezerve mai mult timp pentru stabilirea unui catalog mai amplu al măsurilor de transpunere și al jurisprudenței viitoare;<o:p></o:p>

7. consideră că aplicarea Directivei 2001/29/CE trebuie să se facă într-un cadru mai amplu și ar trebui să ia în considerare în special dispozițiile referitoare la comerțul electronic ale Directivei 2000/31/CE a Parlamentului European și a Consiliului din 8 iunie 2000 privind anumite aspecte juridice ale serviciilor societății informaționale, în special ale comerțului electronic, pe piața internă[10], Directiva 2004/48/CE și dispozițiile privind protecția datelor din Directiva 95/46/CE a Parlamentului European și a Consiliului din 24 octombrie 1995 privind protecția persoanelor fizice în ceea ce privește prelucrarea datelor cu caracter personal și libera circulație a acestor date[11];<o:p></o:p>

8. observă că o eventuală revizuire a Directivei 2001/29/CE nu ar fi oportună, având în vedere că procesul de transpunere de către statele membre s-a încheiat doar în 2006;<o:p></o:p>

9. consideră că Directiva 2001/29/CE reprezintă un echilibru echitabil între interesele diferitelor părți implicate;<o:p></o:p>

10. reamintește că Directiva 2001/29/CE are un rol important în adaptarea dreptului de autor și a drepturilor conexe la societatea informațională;<o:p></o:p>

11. salută intervenția Comisiei, care a facilitat dezbaterile dintre părțile implicate pe tema redevențelor încasate pentru copia privată prin creare unei platforme care reunește reprezentanți ai industriei, ai titularilor drepturilor și ai consumatorilor și care are drept scop evaluarea obiectivă a situației redevenței pentru copia privată și a problemelor legate de aceasta, în special în mediu digital; încurajează platforma respectivă să analizeze, printr-o abordare coerentă și echitabilă, chestiuni *** ar fi sursa legală și criteriile de stabilire a redevenței pentru copia privată, inclusiv rolul anchetelor în rândul consumatorilor în cadrul acestui proces și informațiile care să fie oferite consumatorilor privind redevențele încasate pentru dreptul de autor; solicită Comisiei să informeze Parlamentul cu privire la progresele activității acestei platforme; în plus, consideră că un mediu care să garanteze egalitatea de tratament ar fi în interesul titularilor drepturilor, al consumatorilor și al industriei;<o:p></o:p>

12. se întreabă cu privire la motivele pentru care Cartea verde a Comisiei Europene menționată anterior se axează aproape exclusiv pe domeniul editării, omițând celelalte industrii culturale;<o:p></o:p>

13. amintește Comisiei că, în ceea ce privește reglementarea dreptului de autor și a drepturilor conexe, este esențial și imperativ ca instituțiile UE să coopereze strâns și să acționeze concertat;<o:p></o:p>

14. insistă cu privire la necesitatea unei abordări coerente din partea Comisiei cu privire la dreptul de autor; sugerează că este necesar ca o singură Direcție Generală să coordoneze propunerile provenite din diversele sectoare, pentru a monitoriza respectarea temeiului juridic al dreptului de autor și pentru a evita efectele neprevăzute;<o:p></o:p>

15. consideră că protejarea dreptului de autor, a drepturilor conexe și a proprietății intelectuale constituie un element important pentru a asigura competitivitatea economică a Uniunii Europene;<o:p></o:p>

16. observă că industriile creative sunt un sector în dezvoltare, reprezentând 2,6 % din PIB-ul Uniunii (2003) și oferind peste cinci milioane de locuri de muncă;<o:p></o:p>

17. consideră că industria creativă are un rol esențial în societatea informațională;<o:p></o:p>

18. reamintește că, în cadrul societății informaționale, protecția dreptului de autor și a drepturilor conexe reprezintă un element important pentru dezvoltarea vieții economice a pieței interne și susține cercul virtuos al stimulării activității, al creației, investițiilor și diseminării rezultatelor către consumatorii europeni;<o:p></o:p>

19. subliniază că protejarea dreptului de autor și a drepturilor conexe este una dintre premisele stimulării creativității și inovației, precum și menținerii diverselor identități culturale;<o:p></o:p>

20. recunoaște faptul că o diseminare pe scară largă a cunoștințelor contribuie la crearea unor societăți caracterizate printr-o mai mare incluziune și coeziune socială, dar subliniază că un nivel ridicat de protecție a dreptului de autor este esențial pentru creația de tip intelectual și că, în acest sens, trebuie găsit un echilibru pentru a asigura păstrarea și dezvoltarea creativității în interesul tuturor;<o:p></o:p>

21. reamintește că sistemul dreptului de autor este sistemul cel mai adecvat pentru o economie bazată pe cunoaștere și competență;<o:p></o:p>

22. subliniază că un cadru european de reglementare a dreptului de autor, care să asigure un înalt nivel de protecție, constituie condiția necesară pentru inovare și investiții continue ale editorilor în noi produse și servicii electronice care aduc o contribuție esențială la eforturile Uniunii Europene de a deveni actorul principal în economia bazată pe cunoaștere la nivel mondial;<o:p></o:p>

23. consideră că respectarea dreptului de autor și a drepturilor conexe este cea mai bună garanție pentru dezvoltarea unei piețe legale a produselor digitale;<o:p></o:p>

24. observă că existența unui mare număr de oferte de bunuri și servicii culturale și diseminarea bunurilor și serviciilor respective pe teritoriul Uniunii depinde și de respectarea și protejarea dreptului de autor și a drepturilor conexe;<o:p></o:p>

25. subliniază că dinamismul și diversitatea din domeniul creației europene constituie unul dintre fundamentele libertății de exprimare;<o:p></o:p>

26. reamintește că respectarea dreptului de autor și a drepturilor conexe reprezintă o cale de protejare a diferitelor culturi naționale;<o:p></o:p>

27. afirmă că titularii drepturilor trebuie deci să poată beneficia de protejarea dreptului de autor și a drepturilor conexe în cazul în care astfel de drepturi sunt stabilite, independent de frontierele naționale sau de modalitățile de utilizare, pe durata întregii perioade de valabilitate a acestora;<o:p></o:p>

28. reamintește că societatea informațională deschide noi piețe, în care operele protejate pot fi exploatate prin intermediul produselor electronice și al serviciilor interactive;<o:p></o:p>

29. salută succesul proiectului Europeana, care demonstrează că abordarea europeană care îmbină respectul drepturilor de autor cu un mai bun acces al utilizatorilor la conținuturile creative online funcționează; Europeana, prin voința de a lucra în parteneriat și în dialog constant cu toate părțile implicate, garantează integritatea operelor, precum și o înaltă calitate a digitalizării legale; amintește, între altele, că legislația comunitară în materie de drepturi de autor stabilește că, pentru a digitaliza și a face accesibile operele protejate, chiar și sub formă de extrase, este necesară obținerea unei autorizații de la deținătorii drepturilor; subliniază că acest principiu constituie unul dintre fundamentele Europeenei;<o:p></o:p>

30. consideră că garantarea respectării dreptului moral al autorilor este importantă și își exprimă îngrijorarea cu privire la difuzarea contractelor de muncă („work for hire”) care prevăd încetarea forțată a dreptului de autor și care aduc atingere dreptului la paternitatea și la respectarea operei;<o:p></o:p>

Regimul excepțiilor<o:p></o:p>

31. reamintește că, în temeiul articolului 5 alineatul (5) din Directiva 2001/29/CE, excepțiile prevăzute de directiva respectivă nu sunt aplicabile decât în anumite cazuri speciale, care nu aduc atingere exploatării normale a operei și nici nu cauzează un prejudiciu nejustificat intereselor legitime ale titularului dreptului (rezerva „testului în trei etape”);<o:p></o:p>

32. consideră că digitalizarea operelor culturale ar trebui să respecte dreptul de autor și drepturile conexe și nu trebuie să aducă atingere exploatării normale a operelor pe internet, în special în ceea ce privește veniturile percepute în temeiul dreptului de punere la dispoziție;<o:p></o:p>

33. consideră că abordarea pentru care a optat Directiva 2001/29/CE fondată pe o listă exhaustivă de excepții neobligatorii, este suficient de flexibilă și este valabilă în continuare;<o:p></o:p>

34. consideră că crearea bibliotecilor digitale accesibile online, pe baza proiectelor de digitalizare la scară largă trebuie să se realizeze cu acordul deplin al titularilor dreptului de autor și a drepturilor conexe, pe baza unor acorduri negociate în mod voluntar;<o:p></o:p>

35. consideră că ar trebui aplicată integral excepția prevăzută la articolul 5 alineatul (3) litera (b) din Directiva 2001/29/CE, în beneficiul persoanelor afectate de un handicap;<o:p></o:p>

36. îndeamnă la o analiză privind riscul pe care îl reprezintă pentru dreptul de autor și drepturile conexe excepția care se aplică drepturilor de reproducere și de comunicare din cadrul cercetării științifice aplicate, în cazul învățământului la distanță;<o:p></o:p>

37. consideră că cercetătorii și comunitatea științifică ar trebui să se angajeze în regimuri de acordare a licențelor împreună cu editorii, pentru a consolida accesul la opere în scopuri didactice și de cercetare; atrage atenția, cu toate acestea, asupra importanței revistelor științifice, care joacă un rol determinant în procesul colegial de evaluare în cazul validării rezultatelor cercetării universitare, viabilitatea financiară a acestora fiind asigurată datorită încasărilor din abonamente;<o:p></o:p>

38. consideră că interoperabilitatea între serviciile online și diversele instalații care privesc aceste servicii trebuie să fie încurajată pentru a promova oferta legală și pentru a dezvolta o piață online competitivă;<o:p></o:p>

39. consideră că operele create de utilizatori trebuie să respecte dreptul de autor și drepturile conexe și că nu este necesară crearea unei noi excepții aplicabile „operelor create de utilizatori”;<o:p></o:p>

Punerea în aplicare a drepturilor<o:p></o:p>

40. reamintește că economia din sectorul cultural și reînnoirea creației sunt amenințate de utilizările neautorizate, care prejudiciază grav sectorul creației artistice și inovația tehnologică;<o:p></o:p>

41. recunoaște importanța investițiilor aprobate de către editori în producerea de conținuturi și în publicarea pe suport de hârtie sau digital, și subliniază necesitatea unei combateri eficiente a acțiunilor părților terțe care nu respectă legislația europeană referitoare la dreptul de autor și care prejudiciază aceste investiții;<o:p></o:p>

42. consideră că lupta împotriva pirateriei trebuie să se dezvolte pe mai multe planuri: educație și prevenire, dezvoltarea și accesibilitatea ofertei digitale legale, cooperare și sancțiuni penale;<o:p></o:p>

43. susține promovarea unui mediu favorabil distribuirii și accesului legal la conținutul creativ online;<o:p></o:p>

44. subliniază că este important ca oricărei persoane să i se permită accesul la conținuturi protejate, cu respectarea strictă a dreptului de autor;<o:p></o:p>

45. solicită insistent o clarificare a situației referitoare la o piață concurențială online a dreptului de autor și a drepturilor conexe (având în vedere cauza CISAC);<o:p></o:p>

46. reamintește că activitatea site-urilor internet care oferă descărcarea operelor și a prestațiilor protejate de dreptul de autor sau de drepturile conexe fără consimțământul titularilor drepturilor, precum și schimbul „peer-to-peer” de opere sau de prestații protejate de dreptul de autor sau de drepturile conexe realizat fără consimțământul titularilor drepturilor;<o:p></o:p>

47. susține crearea la nivelul statelor membre a unor mecanisme destinate să asigure respectarea dreptului de autor pe internet, la sesizarea avânzilor drept și folosind o abordare treptată;<o:p></o:p>

48. aprobă acțiunea diferitelor sisteme judiciare naționale împotriva site-urilor internet care difuzează ilegal opere pe rețea (de exemplu „The Pirate Bay”);<o:p></o:p>

49. solicită ca activitatea acestor site-uri să fie suspendată de către autoritățile judiciare din statele membre;<o:p></o:p>

50. invită Comisia să studieze aplicarea articolului 8 alineatul (3) din Directiva 2001/29/CE și să reflecteze asupra celor mai bune mijloace de luptă împotriva pirateriei, în special online, pentru a contribui la promovarea și dezvoltarea unei piețe productive a conținutului online;<o:p></o:p>

51. încurajează lansarea și folosirea noilor tehnologii internet europene, gratuite și descărcabile pentru identificarea și recunoașterea operelor și susține utilizarea tehnologiilor existente pentru a facilita distincția între produsele piratate și cele legale;<o:p></o:p>

52. invită la realizarea unei analize privind răspunderea furnizorilor de acces internet online („providers”) în lupta împotriva pirateriei;<o:p></o:p>

53. solicită cooperarea furnizorilor de acces internet pentru prevenirea și reprimarea pirateriei electronice;<o:p></o:p>

54. solicită dezvoltarea unei oferte legale de opere pe internet, de exemplu prin scăderea TVA în cazul prestațiilor digitale;<o:p></o:p>

55. consideră, pe de o parte, că educația și sensibilizarea sunt esențiale și, pe de altă parte, invită Comisia să asigure transparența și interoperabilitatea sistemelor de gestiune a drepturilor digitale;<o:p></o:p>

56. solicită Comisiei să extindă domeniul de aplicare al următorului său raport de evaluare a Directivei 2001/29/CE astfel încât să cuprindă și aplicarea articolului 3 alineatul (2) litera (a) al acesteia; recomandă Comisiei să caute noi mijloace de a ameliora situația artiștilor interpreți în cazul în care aplicarea dreptului prevăzut de această dispoziție este considerată insuficientă;<o:p></o:p>

57. încredințează Președintelui sarcina de a transmite prezenta rezoluție Consiliului și Comisiei.<o:p></o:p>

EXPUNERE DE MOTIVE<o:p></o:p>

I. Dreptul de autor și drepturile conexe în societatea informațională<o:p></o:p>

<o:p> </o:p>

Apărarea dreptului de autor și a drepturilor conexe în cadrul societății informaționale constituie un element important pentru dezvoltarea vieții economice a pieței interne.<o:p></o:p>

În mod tradițional, dreptul de autor recunoaște autorului două drepturi patrimoniale majore: dreptul de reproducere și dreptul de comunicare către public. <o:p></o:p>

Societatea informațională deschide noi piețe în care operele protejate pot fi exploatate prin intermediul produselor electronice și al serviciilor interactive. <o:p></o:p>

În acest context, apărarea dreptului de autor și a drepturilor conexe este una dintre condițiile pentru stimularea creativității și a inovării, dar și a identităților culturale diferite. <o:p></o:p>

Dreptul de autor și drepturile conexe nu sunt doar o recompensă ex post a muncii creatorilor, ci și un mijloc de a-i încuraja să creeze mai mult. Acest aspect stimulant este și mai important pentru producătorii și intermediarii din distribuție.<o:p></o:p>

Titularii drepturilor trebuie deci să poată beneficia de apărarea dreptului de autor și a drepturilor conexe în cazul în care astfel de drepturi sunt stabilite, independent de frontierele naționale sau de modalitățile de utilizare, pe durata întregii perioade de valabilitate a acestora.<o:p></o:p>

În societatea informațională pirateria împiedică continuarea unei activități creatoare care ar trebui să fie rentabilă din punct de vedere financiar. <o:p></o:p>

Trebuie avut în vedere că bunurile informaționale au o structură de cost atipică în care cea mai mare parte a cheltuielilor se situează în faza de concepere și producție.<o:p></o:p>

Trebuie evitat ca dreptul de autor să fie denaturat de progresul tehnologic<o:p></o:p>

<o:p> </o:p>

Lupta împotriva pirateriei trebuie să se dezvolte pe mai multe planuri: educație și prevenire, dezvoltarea accesibilității la oferta legală numerică, cooperare și sancțiuni penale.<o:p></o:p>

În prezent este necesar să se garanteze echilibrul între interesele legitime ale autorilor și interesele publicului și ale societății, în lumina Declarației universale a drepturilor omului a ONU, al cărei articol 27 stipulează: „1) Orice persoană are dreptul de a lua parte în mod liber la viața culturală a colectivității, de a se bucura de arte și de a participa la progresul științific și la binefacerile lui. 2) Fiecare om are dreptul la ocrotirea intereselor morale și materiale care decurg din orice lucrare științifică, literară sau artistică al cărei autor este.”<o:p></o:p>

Directiva 2001/29 CE privind armonizarea anumitor aspecte ale dreptului de autor și drepturilor conexe în societatea informațională are un obiectiv triplu:<o:p></o:p>

– reafirmarea drepturilor autorilor și titularilor de drepturi conexe ținând cont de caracteristicile mediului digital;<o:p></o:p>

– definirea regimului excepțiilor de la aceste drepturi;<o:p></o:p>

– asigurarea protecției juridice a măsurilor tehnice aplicate operelor și prestațiilor pentru a împiedica actele neautorizate de titularii drepturilor.<o:p></o:p>

Directiva se înscrie în linia tratatelor din 1996 ale Organizației Mondiale a Proprietății Intelectuale (OMPI) privind dreptul de autor.<o:p></o:p>

<o:p> </o:p>

Directiva a lăsat multă libertate statelor membre pentru transpunerea acesteia, creând uneori incertitudine juridică în cadrul fiecărui stat și disparități între statele membre din cauza caracterului opțional al multor dispoziții, care lasă statelor membre libertatea de a adopta „à la carte” numeroase excepții de la drepturile enunțate și încredințând statelor membre în termeni uneori vagi sarcina de a pune în aplicare protecția juridică.<o:p></o:p>

II. Elemente pentru evaluarea aplicării Directivei 2001/29 CE<o:p></o:p>

<o:p> </o:p>

Raportul Comisiei Europene privind aplicarea Directivei 2001/29 CE privind armonizarea anumitor aspecte ale dreptului de autor și drepturilor conexe în societatea informațională (SEC 2007/1556), examinează transpunerea de către statele membre și aplicarea de către instanțele naționale a articolelor 5 (excepții și limitări), 6 (obligații privind măsurile tehnice) și 8 (sancțiuni și căi de atac) din directiva în cauză.<o:p></o:p>

Regimul excepțiilor, aplicarea și transpunerea practică a acestuia <o:p></o:p>

<o:p> </o:p>

– articolul 5 din directivă enunță o excepție obligatorie (alineatul (1)) și excepții opționale exclusiv de la dreptul de reproducere ( alineatul (2)) sau de la dreptul de reproducere, de comunicare către public și de punere la dispoziția publicului (alineatul (3)), excepții opționale care se pot extinde și asupra dreptului de distribuție (alineatul (4)).<o:p></o:p>

– alineatul (5) supune toate excepțiile și limitările drepturilor diverse enunțate doar de directivă la regula „triplului test”, adică „limitările se aplică doar în anumite cazuri speciale care nu intră în conflict cu exploatarea normală a obiectelor protejate și care nu aduc în mod nejustificat atingere intereselor legitime ale titularului dreptului.” Acest „triplu test” își găsește originea în articolul 9 alineatul (2) din Convenția de la Berna referitor la dreptul de reproducere a operelor literare și artistice și în articolul 10 din tratatele OMPI din 1996.<o:p></o:p>

<o:p> </o:p>

Articolul 5 alineatul (1) prevede exceptarea actelor provizorii de reproducere care sunt tranzitorii și accesorii și care constituie o parte integrantă a unui proces tehnic.<o:p></o:p>

Articolul 2 din directivă afirmă dreptul de reproducere în termenii cei mai largi, însă în mediul digital reproducerile sunt numeroase, adesea efemere. Acestea nu sunt mai puțin vizate de dreptul exclusiv, motiv pentru care o reproducere ca cea necesară anumitor modalități de comunicare face obiectul unei excepții, singura obligatorie în directivă (articolul 5 alineatul (1)).<o:p></o:p>

Dimpotrivă, prin hotărârea Google-Copiepresse din 13 februarie 2007, judecătorul belgian a decis că o copie unei pagini web memorată de serverul Google și existența unei legături care face posibil accesul public la respectiva pagină web contravine dreptului de reproducere și dreptului de comunicare către public.<o:p></o:p>

<o:p> </o:p>

Toate statele membre, cu excepția Regatului Unit și a Irlandei, au transpus cu diferențe excepția pentru reproducerile pentru uz personal prevăzută la articolul 5 alineatul (2) litera (b). De asemenea, judecătorul belgian și francez a statuat că nu este vorba de un drept aplicabil încă (Test Achats v. EMI, Curtea de Apel din Bruxelles 9/92005 și Studio Canal v S. Perquin et Union fédérale des consommateurs Que Choisir Curtea de Casație din Paris din 28.2.2006). <o:p></o:p>

<o:p> </o:p>

Excepția prevăzută la articolul 5 alineatul (2) litera (c), în favoarea actelor specifice de reproducere realizate de biblioteci sau de orice organism al cărui scop nu este obținerea de avantaje comerciale, nu este nelimitată. Aceasta se limitează la cazuri specifice, de exemplu reproduceri necesare pentru păstrarea lucrărilor conținute în cataloagele din biblioteci. <o:p></o:p>

De exemplu, editorii consideră că au dreptul să ofere autorizația prealabilă pentru scanarea unei cărți, ca în recursul împotriva Google înaintat la data de 6.6.2006 Tribunalului de Mare Instanță din Paris de Grupul La Martinière și alții. <o:p></o:p>

Este evident că punerea on-line a operelor de către bibliotecile digitale poate reprezenta o pagubă foarte mare pentru titularii drepturilor de autor.<o:p></o:p>

<o:p> </o:p>

Excepția prevăzută în favoarea presei la articolul 5 alineatul (3) litera (c) pentru relatarea evenimentelor de actualitate a fost interpretată de unele state membre într-un sens foarte larg, dar în hotărârea Copiepresse v. Google judecătorul belgian a considerat că reproducerea de către Google a unor porțiuni de articol fără comentariu nu este acoperită de această excepție. Aceeași hotărâre nu consideră aplicabilă serviciului Google.News excepția pentru citatele făcute în scop de critică sau de recenzie în temeiul articolului 5 alineatul (3) litera (d). <o:p></o:p>

Excepția prevăzută la articolul 5 alineatul (3) litera (k) atunci când este vorba de utilizarea în cazul caricaturii sau parodierii a fost transpusă în legislațiile naționale cu diferențe sensibile; de exemplu, aceasta nu este prevăzută în Regatul Unit, dar este reglementată în mod strict în Germania în baza jurisprudenței Curții Regionale din Hamburg prin decizia acesteia privind „thumbnails” din 5.9.2003.<o:p></o:p>

Protecția măsurilor tehnice<o:p></o:p>

<o:p> </o:p>

Articolul 6 din directivă solicită statelor o protecție juridică adecvată<o:p></o:p>

împotriva nerespectării oricăror măsuri tehnice eficiente (TPM technological protection measures) și împotriva difuzării acestora. <o:p></o:p>

Articolul 6 alineatul (3) prevede că „măsuri tehnice” înseamnă:<o:p></o:p>

„orice tehnologie, dispozitiv sau componentă care, în cadrul funcționării normale, este proiectată pentru a preveni sau limita, în ceea ce privește operele sau alte obiecte protejate, acte care nu sunt autorizate de titularul dreptului de autor al unui drept conex dreptului de autor conform dispozițiilor legale sau de titularul dreptului sui generis prevăzut la capitolul III din Directiva 96/9/CE”. <o:p></o:p>

În Regatul Unit, hotărârea Sony Computer Entertainment v Ball, a High Court of Justice din 2005 a stabilit că, pentru a face ca o măsură tehnică de apărare (TPM) să se încadreze în definiția de la articolul 6 alineatul (3) trebuie stabilit dacă aceasta a fost creată special în acest scop („it is necessary to determine whether i tis designed in the normal course of its operation top revent unauthorised use of copyright work in a way which would amount to an infringement of copyright”). <o:p></o:p>

Jurisprudența germană, prin hotărârea Heise Online din 2005, a stabilit interdicția de a oferi software de deformare a oricărei măsuri tehnice de apărare chiar și prin legături cu un „offshore website”.<o:p></o:p>

<o:p> </o:p>

Noțiunea de „măsură tehnică eficace” a fost transpusă de toate statele membre cu excepția Slovaciei și a Suediei.<o:p></o:p>

<o:p> </o:p>

Alineatul (4) din articolul 6 prevede că statele membre pot să ia măsuri adecvate pentru a garanta excepțiile – în absența măsurilor voluntare luate de titularul de drepturi – pentru apărarea măsurilor tehnice de protecție în favoarea beneficiarilor prevăzute la articolul 5 alineatul (2) literele (a), (b), (c) și (e) și la articolul 5 alineatul (3) literele (a), (b) și (e). Această noțiune destul de largă de „măsuri adecvate” găsește diferite aplicații în statele membre, de exemplu nu a existat nicio transpunere în Austria, Cehia, Țările de Jos; dimpotrivă, există măsuri de mediere și de arbitraj în Finlanda, Danemarca, Estonia, Grecia și Ungaria sau posibilitatea de recurgere la justiție în Belgia, Germania, Spania și Irlanda. În sfârșit, Franța prevede recurgerea la calea administrativă. <o:p></o:p>

Sancțiuni și protejarea titularilor dreptului de autor și drepturilor conexe <o:p></o:p>

<o:p> </o:p>

Articolul 8 alineatul (3) din Directiva 2001/29 prevede ca „statele membre trebuie să asigure că titularii de drepturi pot solicita ca o ordonanță președințială să fie pronunțată împotriva intermediarilor ale căror servicii sunt folosite de către terți pentru a contraface dreptul de autor sau un drept conex”. Doar Austria, Grecia, Lituania și Belgia au transpus în mod clar acest articol, care în celelalte state membre este acoperit de legislația existentă.<o:p></o:p>

<o:p> </o:p>

În ultimii ani, au existat mai multe acțiuni judiciare împotriva furnizorilor de acces și împotriva gazdelor. <o:p></o:p>

La 29 iunie 2007, Tribunalul de Primă Instanță din Bruxelles a ordonat întreprinderii Scarlet (fosta Tiscali) să instaleze „filtre” pentru a preveni deturnarea fișierelor „peer-to-peer”. În același sens, la 10.2.2006 judecătorul danez a cerut unui server să taie conexiunea Internet clienților care aduc atingere dreptului de autor, iar la 25.10.2006, tot în Danemarca, s-a ordonat serverului TELE2 să blocheze accesul clienților săi la site-ul rusesc AllofMP3.com care permitea descărcarea ilegală a cântecelor.<o:p></o:p>

<o:p> </o:p>

Un sector foarte delicat este cel al „peer to peer”, adică fenomenul site-urilor Internet și al programelor prin care utilizatorii internetului împart între ei, direct sau prin intermediul unui site comun, fișiere care conțin reproduceri de opere sau prestații protejate fără consimțământul titularilor drepturilor (Napster, centralizat, Kazaa, descentralizat).<o:p></o:p>

<o:p> </o:p>

Activitatea site-urilor, dincolo de acest fenomen „peer to peer” care oferă descărcarea de opere sau de prestații protejate fără autorizațiile necesare, este ilegală și nu este susceptibilă să se aplice nicio excepție. <o:p></o:p>

Astfel, activitatea internauților care transmit omologilor lor fișiere trebuie să fie considerată drept un act ilegal de comunicare către public fără posibilitatea de a aplica excepții.<o:p></o:p>

În ceea ce privește activitatea „download”, ne putem îndoi că aceasta constituie un act de reproducere care poate beneficia de excepția de copie privată (articolul 5 alineatul (2) litera (b)) efectuat de o persoană fizică pentru utilizarea sa personală și care nu are scopuri nici direct, nici indirect comerciale, însă în acest caz trebuie avută în vedere și originea licită sau nu a sursei. <o:p></o:p>

Pe aceste baze titularii drepturilor convin în prezent realizarea de acorduri cu furnizorii de acces. Aceștia propun punerea la punct de proceduri de notificare a activităților ilegale suspectate pentru ca furnizorii de acces să ia, în intervalele adecvate, măsurile care se impun față de internauți și să furnizeze datele complete ale acestora în scopul urmăririi judiciare. Toate acestea pot intra însă în contradicție cu protecția datelor cu caracter privat.<o:p></o:p>

Într-adevăr, în temeiul hotărârii „Telefonica” din 29.01.08 a CJCE., dreptul comunitar nu impune statelor membre obligația de a divulga date cu caracter personal în cadrul unei proceduri civile, în vederea asigurării protecției efective a dreptului de autor. Cu toate acestea, Curtea ridică problema concilierii necesare a apărării diferitelor drepturi fundamentale, și anume dreptul de respectare a vieții private cu drepturile pentru apărarea proprietății intelectuale și dreptul la căi de atac efective. Hotărârea „Telefonica” confirmă importanța protejării drepturilor de proprietate intelectuală și nu împiedică în niciun mod furnizorii de acces și pe ceilalți operatori online să colaboreze cu avânzii drept în lupta împotriva pirateriei pe internet.<o:p></o:p>

SUGESTII<o:p></o:p>

Comisia pentru industrie, cercetare și energie recomandă Comisiei pentru afaceri juridice, competentă în fond, includerea următoarelor sugestii în propunerea de rezoluție ce urmează a fi adoptată:<o:p></o:p>

1. reafirmă că societatea informațională este un pilon fundamental al Strategiei de la Lisabona ce se bazează atât pe accesul la cunoștințe, cât și pe protecția conținutului digital printr-un sistem riguros și eficient de protejare a drepturilor de autor si a drepturilor conexe și reafirmă, de asemenea, că o astfel de protecție trebuie să promoveze inovarea, să respecte principiul neutralității tehnologice și să țină seama de interesele legitime ale consumatorilor și ale furnizorilor de servicii de internet care respectă legea;<o:p></o:p>

2. evidențiază nevoia asigurării certitudinii juridice în ceea ce privește dreptul de autor în societatea informațională și subliniază nevoia unei armonizări mai profunde în acest domeniu, atât în cadrul UE, cât și între UE și Statele Unite;<o:p></o:p>

3. reamintește faptul că Directiva 2001/29/CE a Parlamentului European și a Consiliului din 22 mai 2001 privind armonizarea anumitor aspecte ale dreptului de autor și drepturilor conexe în societatea informațională[12] reprezintă un element esențial al legislației comunitare privind protecția proprietății intelectuale în mediul digital, în conformitate cu „Tratatele privind internetul” ale Organizației Mondiale a Proprietății Intelectuale (OMPI); reamintește, de asemenea, că această legislație și-a dovedit eficiența în practică, contribuind la promovarea unei comunități dinamice în Uniunea Europeană;<o:p></o:p>

4. constată că tehnologiile informaționale impun necesitatea adoptării unor drepturi de autor și drepturi conexe moderne și că trebuie garantată protecția acestor drepturi, făcând o distincție clară între autoritățile publice responsabile de punere aplicare și operatori, care acționează în conformitate cu dispozițiile în vigoare;<o:p></o:p>

5. reamintește creșterea rapidă pe internet a volumului conținutului creat de utilizatori și contribuția adusă de acesta la creativitate; recunoaște că valoarea acestui sector este în creștere permanentă; constată că schimbul de informații reprezintă o condiție prealabilă pentru aceasta și că acest fapt trebuie luat în considerare; reamintește, în acest context, că deși protecția drepturilor de autor stimulează investițiile și producerea de conținut, unele excepții, analizate cu atenție, sunt la fel de esențiale pentru asigurarea accesului la cunoștințe, la creație și la inovare;<o:p></o:p>

6. subliniază faptul că raportul Comisiei privind aplicarea Directivei 2001/29/CE constată că în statele membre există cazuri de implementare diferită a prevederilor articolelor 5, 6 și 8, ceea ce conduce la interpretări și hotărâri diferite ale instanțelor judecătorești din statele membre, și reamintește că acestea au devenit parte a jurisprudenței specifice;<o:p></o:p>

7. solicită Comisiei să continue monitorizarea riguroasă a aplicării Directivei 2001/29/CE și raportarea periodică a constatărilor către Parlamentul European și către Consiliu;<o:p></o:p>

8. salută adoptarea de către Comisie a Cărții verzi intitulată „Dreptul de autor în economia cunoașterii” (COM(2008)0466) și invită Comisia ca, după consultarea tuturor factorilor implicați, să revizuiască Directiva 2001/29/CE astfel încât prevederile articolelor 5, 6 și 8 să dobândească mai multă precizie în vederea asigurării la nivel comunitar a armonizării cadrului juridic privind protecția drepturilor de autor în societatea informațională;<o:p></o:p>

9. invită Comisia să examineze, la evaluarea altor aspecte ale Directivei 2001/29/CE, inclusiv a Cărții verzi menționate anterior, să țină seama de Rezoluția Parlamentului din 31 ianuarie 2008 privind Spațiul European de Cercetare: perspective noi[13], care subliniază importanța respectării proprietății intelectuale și evidențiază faptul că investițiile realizate de edituri în infrastructură, funcționalitate și inițiative privind sistemele de referințe încrucișate au dus la îmbunătățiri importante în diseminarea informațiilor și a cunoștințelor.<o:p></o:p>

Comisia pentru piața internă și protecția consumatorilor recomandă Comisiei pentru afaceri juridice, competentă în fond, includerea următoarelor sugestii în propunerea de rezoluție ce urmează a fi adoptată:<o:p></o:p>

1. ia act de faptul că industriile creative sunt un sector în dezvoltare care reprezintă 2,6 % din PIB-ul Uniunii (2003) și care oferă peste cinci milioane de locuri de muncă;<o:p></o:p>

2. reamintește că, în cadrul societății informaționale, protecția dreptului de autor și a drepturilor conexe reprezintă un element important pentru dezvoltarea vieții economice a pieței interne, care susține cercul virtuos al stimulării activității, al creației, investițiilor și diseminării rezultatelor către consumatorii europeni; <o:p></o:p>

3. reamintește obligația Comunității Europene și a statelor membre de a respecta cadrul internațional care reglementează dreptul de autor, și anume articolul 9 alineatul (2) din Convenția de la Berna din 1886 pentru protecția operelor literare și artistice și articolul 13 din Acordul privind aspectele comerciale ale drepturilor de proprietate intelectuală, ai cărui termeni se regăsesc la articolul 5 alineatul (5) din Directiva 2001/29/CE;<o:p></o:p>

4. subliniază că este important ca oricărei persoane să i se permită accesul la informații protejate, cu respectarea strictă a dreptului de autor;<o:p></o:p>

5. constată că măsurile adoptate pe plan tehnologic nu trebuie să restricționeze în mod excesiv sau nejustificat drepturile persoanelor care consumă în mod legal produse protejate de dreptul de autor;<o:p></o:p>

6. recunoaște faptul că o diseminare pe scară largă a informațiilor contribuie la deschidere și la coeziune socială, dar subliniază că un nivel ridicat de protecție a dreptului de autor este esențial pentru creația de tip intelectual și că, în acest sens, trebuie găsit un echilibru pentru a asigura păstrarea și dezvoltarea creativității în interesul tuturor;<o:p></o:p>

7. subliniază că un cadru european de reglementare a dreptului de autor, care să asigure un înalt nivel de protecție, constituie condiția necesară pentru inovare și investiții continue ale editorilor în noi produse și servicii electronice care aduc o contribuție esențială la eforturile Uniunii Europene de a deveni actorul principal în economia cunoașterii la nivel mondial;<o:p></o:p>

8. consideră că excepțiile și limitările în aplicarea dreptului de autor și a drepturilor conexe sunt prevăzute în modul cel mai eficient la nivel național, întrucât acest lucru face posibilă găsirea soluțiilor celor mai flexibile în contextul unei societăți informaționale care evoluează rapid;<o:p></o:p>

9. constată că acest prim raport referitor la aplicarea articolelor 5, 6 și 8 ale Directivei 2001/29/CE nu permite o evaluare pertinentă, dată fiind transpunerea târzie de către statele membre și solicită, prin urmare, Comisiei, să își concentreze eforturile asupra punerii în aplicare depline a Directivei 2001/29/CE sub toate aspectele sale și să asigure un echilibru între garantarea unei remunerații pentru titularii dreptului de autor și diseminarea în beneficiul consumatorilor europeni;<o:p></o:p>

10. regretă faptul că, în raportul său, Comisia nu ia în considerare practica legislativă a țărilor care au devenit membre ale Uniunii după adoptarea directivei;<o:p></o:p>

11. recomandă Comisiei să își rezerve mai mult timp pentru stabilirea unui catalog mai amplu al măsurilor de transpunere și al jurisprudenței viitoare;<o:p></o:p>

12. consideră că aplicarea acestei directive trebuie să se facă într-un cadru mai amplu și ar trebui să ia în considerare în special dispozițiile referitoare la comerțul electronic ale Directivei 2000/31/CE a Parlamentului European și a Consiliului din 8 iunie 2000 privind anumite aspecte juridice ale serviciilor societății informaționale, în special ale comerțului electronic, pe piața internă[14], precum și Directiva 2004/48/CE a Parlamentului European și a Consiliului din 29 aprilie 2004 privind respectarea drepturilor de proprietate intelectuală[15] și dispozițiile privind protecția datelor ale Directivei 95/46/CE a Parlamentului European și a Consiliului din 24 octombrie 1995 privind protecția persoanelor fizice în ceea ce privește prelucrarea datelor cu caracter personal și libera circulație a acestor date[16];<o:p></o:p>

13. ia act de faptul că Directiva 2001/29/CE prevede posibilitatea recurgerii la căi de atac legale pentru asigurarea respectării drepturilor și sprijină dezvoltarea și utilizarea în continuare a alternativelor care includ sisteme de arbitraj, mediere sau autoreglementare ce implică diferiții actori din sfera lumii digitale;<o:p></o:p>

14. consideră, pe de o parte, că educația și sensibilizarea sunt esențiale și invită, pe de altă parte, Comisia să asigure transparența și interoperabilitatea sistemelor de gestiune a drepturilor digitale.<o:p></o:p>

Your site can be a calling card for a brick-and-mortar business, you can sell, rent lease or contract out goods or services with your site, or you can use it for both. They are not the only uses for a web site, however, and the variety of purposes grows every day. Here are some examples we have seen here:

A domain name is a unique name that identifies your Internet site, for example, northwindtraders.com. When setting up your Web site in Microsoft Office Live Small Business, you can search for a new domain name or transfer an existing domain name.

Note: Before you begin to register or transfer a domain name, see the Microsoft Office Live Small Business Worldwide page to check the countries/regions where Office Live Small Business is available. To learn which Office Live Small Business features are available in a specific country, click the link for that country/region.

On the Office Live Small Business Home page, click More and then click Domain Manager.
On the left navigation bar, click Domain Manager.
Click Purchase additional domains.
In the Domain name box, type the domain name that you want to use, select the domain suffix (for example, .com, .org, or .net) from the list, and then click Check availability.

Note: The annual cost of registering a new domain name is listed on this page, next to the Domain name box.
If the domain name is not available, you are asked to choose a different domain name. Type a different domain name or choose a different suffix, and then click Check availability.
If the domain name is available, make sure it is spelled the way you want to appear, and then click Confirm.

Important:

If you want your new domain name to be the main domain that customers use, you must set it to be your primary domain You can register additional domain names to send traffic to your primary domain.
Each Office Live Small Business account is associated with one Web site. If you want to create a second Web site that is not related to the first, you must create a second Office Live Small Business account.

Learn how to choose a domain name

Technology wizards have made it easier than ever for small businesses to get on the Web. With services like Office Live Small Business, for example, you can have a full-featured Web site up and running in a couple of hours. What remains a challenge, however, is coming up with a good domain name —the Internet identifier that not only serves as your Web site address, but also says a lot about your business.

For example, if you owned and operated an adventure travel company called Adventure Works, you might settle for using adventure-works.com as your domain name. But if Adventure Works actually specializes in sailing trips off the coast of Tanzania, then a more specific name incorporating these terms might drive more relevant search engine traffic your way.

So think carefully when choosing your domain name. It not only points people to your Web site, but it becomes powerful part of your business identity and brand. And also be prepared to have more than one idea for a name. There's a good chance that your first name choice is not available because another person has already claimed it.

Tips for choosing your domain

Choose a short, memorable domain name. It is easier for your customers to recall, and is easier to display on your logos, business cards, and billboards.
When selecting your domain name, choose one or two words that are easy to spell. Also, before registering your domain name, make sure that the spelling is correct and that the domain name you specified is what you want.
Try to avoid using numbers and hyphens in your domain name. If you register the name "my-company23.com," you will have to tell people that your domain name is "my hyphen company twenty-three dot com." It is easier for people to remember your domain name if it is short and simple.
Choose a domain name that relates to your business or organization. Choosing a name that is related to your business makes it easier for your Web site visitors to remember the URL.
The domain name can contain only letters, numbers, and hyphens; it must consist of 3 to 40 characters, and begin and end with a number or letter. Spaces are not allowed.
When you are securing or buying domain names, you may want to buy more than one. Consider buying a name with the keywords that capture type-in traffic. Type-in traffic refers to users who reach sites by typing keywords into the address bar of their Web browser instead of using a keyword search on a search engine. Also consider buying the domain names that are variations of your Web site domain name or are a misspelled version of it. You can redirect users to your site with these additional names.

Microsoft Office Live Small Business contains several lists in Business Applications and Contact Manager, such as a Projects list or a Document Library, that you can use to store the information you need to reference often as part of your business day. You can also choose to display information from these lists on your public Web site, so visitors can see it. When you change information in the list, the information displayed on your public Web site is updated automatically.

For example, if a restaurant wants to post its daily specials to customers online, the restaurant owner can create a list called “Daily Specials” in Business Applications and publish the list to the restaurant's Web site. When he or she updates the “Daily Specials” list in Business Applications, the list automatically updates on the Web site where customers can see it, too.

There are two ways to publish a list to your public Web site. If you're working in Business Applications or Contact Manager, you can go to the Sharing sidebar and select Lists. Or, for more flexibility, go to Web designer and add a List Publisher module that lets you choose your own template or add multiple modules to your page.

Publish a list to your public Web site using the Sharing sidebar

On the Office Live Small Business Home page, on the left navigation bar, click Business Applications or Contact Manager. (If your comming in from home.office.live - you can find these two items on the "More" menu at the top of your page)
In the left navigation bar, click the application that contains the list that you want to publish. Then click the name of the specific list that you want.
In the Sharing sidebar, click Lists, and then click Publish a list.
In the dialog box that opens, create a name that will appear at the top of your new Web page, and create the Web address (URL) that will appear in the address bar of the new Web page. Then click Publish list. For more information about creating page names and Web addresses, see: Add or remove a Web page.
The dialog box closes. Web designer automatically opens in a new browser window and your new Web page appears. Instructional text appears at the top of the page. Right-click the instructional text, and then click Properties.
Select the fields that you want to include on your public Web page, reorder them as you want by using the Move up and Move down buttons, and then choose a layout.
Choose whether you want the list to be available to others as an RSS feed. Feeds are a great way to expand your Web site's audience by letting visitors receive automatic updates any time you change your list.
Click OK. Your list appears on its own Web page in the layout that you selected.

Note: You can customize your list module using the advanced Web site design features. To learn about the list publisher module advanced design features, see Customize a list on a Web page using the advanced design features.

Publish a list to your public Web site by adding a List Publisher module

On the Office Live Small Business Home page, on the left navigation bar, click Web Site.
In Page Manager, next to the name of the Web page that contains the list that you want to publish, click Edit.
In the Page Editor toolbar, click Module, and then click List publisher.
From the Application drop-down list, select the name of the application where the list is stored. From the List drop-down list, select the name of the list that you want to display.

Remove a list from your public Web site

On the Office Live Small Business Home page, on the left navigation bar, click Web Site.

In Page Editor, right-click anywhere in the module that you want to remove, and then click Delete.

HOWTO: GNU/Linux works with Office Live

Not that any GNU/Linux users out there would be using Office Live in the first place, but as an old beta tester to the program I couldn't help but get Office live to work under GNU/Linux.

The support techs will tell you simply that Linux is unsupported just so that they would not have to hassle with it (I would assume). I love to prove people wrong when they say that a program can't do something that it should. Here is how I did it.

Firefox users, under Firefox install the plugin "user-agent-switcher" this will mask your Firefox browser so that Office live will think that you are running IE6, 7 or 8 and Windows. This works for logging into your account and doing basic functions that will otherwise be blocked after the built in browser compatibility test. (Firefox is supported, but the user agent string also shows your operating system..)

Linux users, same method as above for minimal access. I have not been able to access the website construction set with the "agent-switcher" as mentioned but I have been able to access it though the use of wine software. Simply install Firefox for Windows under Wine and everything will work... As best as Wine can anyway.

I've tested this with Firefox V3.5 (both variants) and Wine 1.18 emulating Windows XP.

Only issues so far is that Firefox will simply not load the website builder as stated under the Linux version and Wine likes to crash if the page is maximized, the later could very well be my system as I run all beta software designed for the beta testers.

Under Tools--> Internet Options--> Security - set level to medium

Under Tools--> Internet Options--> Advanced - UNcheck the Use Passive FTP box (scroll about halfway down to find this setting)

I've not been using Office Small Business for very long; however, I am currently going through withdraws. I was a member of Yahoo Geocities and I was allowed to do a little more than I'm allowed with the microsoft generator. I would like to be able to do things like add a counter to see how many people have visited or add a clock. But the most important to me is to make it look more professional. I mean It's microsoft but there isn't half the editing options you would have in like microsoft word. I mean an Undo button would be nice! Just do a little upgrade microsoft, please?

You can redirect any domain that you own to your new Microsoft Office Live Small Business Web site. When you do so, any visitors to that domain are redirected to your Web site on Office Live Small Business. With redirection, you don't have to worry about maintaining multiple domains or losing customers to dead-end Web addresses. A redirected domain brings its traffic to your Web site on Office Live Small Business.

If you want to retain your e-mail accounts at your current Web site address, you can choose to partially redirect your Web site. This moves other Web site files to the Office Live Small Business server, but it keeps your e-mail accounts in their current location.

Notes:

If you have a custom domain through Windows Live (for example, one using the format www.fourthcoffee.com), you can partially redirect that domain to Office Live Small Business, but not completely. In other words, you can redirect the Web site traffic of your Windows Live custom domain to your Office Live Small Business account, but not your custom domain's e-mail services. Those e-mail services will continue to be hosted through your account with Windows Live.
After you completely redirect a domain to Office Live Small Business, you cannot choose to partially redirect it later or move your e-mail accounts back to their previous location.

Redirect your existing domain name to Office Live Small Business

If your current domain name registrar appears in the following list, click the applicable link for assistance. If your domain registrar is not listed, use the instructions following the list.

Redirecting your current Web site address to your new Office Live Small Business Web site is a two-step process. First, you redirect your domain in Office Live Small Business, and then you change the name server settings with your current domain registrar to complete the redirection process.

Redirect your domain in Office Live Small Business

On the Office Live Small Business Home page, on the left navigation bar, click Add/Manage Services.
Under Choose a Category, click Web Site and E-Mail, and then, next to Domains, click sign up.
Next to Already have a domain?, click Redirect it to Microsoft Office Live Small Business.
In the Domain to redirect box, type the domain name that you want to redirect to your Office Live Small Business account, and then select the extension that you want in the drop-down list next to the Domain to redirect box.
Click Confirm.
Under Complete Signing Up, review the user agreement. If you agree, click Complete my Order.

Change the name server settings with your domain registrar

Log on to your current domain name registrar's Web site.
Locate the section on your domain registrar's Web site where you can change your name server settings. This section may be labeled in one of the following ways.
- Edit DNS
- Name Server Settings
- DNS Server Settings
Enter the Office Live Small Business primary and secondary name servers, NS1.officelive.com and NS2.officelive.com, and then save the information.

Note: If you cannot change your name server settings using these instructions, contact your domain registrar's customer service for further assistance.
To check the status of your account, on the Office Live Small Business Home page, on the left navigation bar, click Domain Manager. When Active appears in the Status column next to your domain name, your domain name will point to your Office Live Small Business Web site.

Notes:
- Please allow 24–72 hours to complete the redirection process. This is not a domain transfer. Your domain name registration remains with your current registrar, and you will continue to be responsible for domain name fees and renewal with that organization.
- If you do not complete all of the previous steps within five days, you must refresh your domain entry on the Domain Manager page and start the process again.

Partially redirect your domain name to Office Live Small Business

You can choose to redirect some of your current Web site files to your new Office Live Small Business Web site, but keep your e-mail accounts at your current Web site address.

On the Office Live Small Business Home page, on the left navigation bar, click Domain Manager.
Click Use your own domain name.
In the Domain to redirect box, type the domain name that you want to redirect to your Office Live Small Business account, and then select the extension that you want in the drop-down list next to the Domain to redirect box.
Select Web site only, and then click OK.
Return to Domain Manager, and click the Properties link for the domain you just redirected. Under Domain Details, take note of the A-record IP address and write it down. The A-record is the numeric equivalent of your domain name. You will use this address to update the A-record settings for your domain with your current registrar.

Completely redirect your partially redirected Web site

If you partially redirect your Web site files to your new Office Live Small Business account and later want to also move your e-mail accounts, you can completely redirect your partially redirected Web site.

On the Office Live Small Business Home page, on the left navigation bar, click Domain Manager.
Click Properties for the domain name that you want to redirect completely.
On the Domain Properties page, click Edit Properties.
Select Web Site and E-mail, and then click Save.
Log on to your registrar's Web site, and change the name server settings for the domain to point to Office Live Small Business name servers.
To add your existing e-mail account to Office Live Small Business, on the Office Live Small Business Home page, on the left navigation bar, click Account Settings, and then click E-mail Accounts. Click Create new E-mail account.

Note: You will not receive e-mail messages sent to any existing e-mail addresses until you create those accounts using Office Live Small Business.

Find the registrar for a domain name

If you want to redirect your existing domain name to Office Live Small Business, but you aren't certain who your current registrar is, do the following to find the registrar.

Open your browser, and go to the InterNIC Web site.
In the Whois box, type your domain name. For example, type fourthcoffee.com.
Verify that the Domain button is selected, and then click Submit. The name of the registrar appears on the page.

For Whois information about country-code top-level domains (for example, those ending in .de or .fr), go to UWhois.com.

If you have an existing domain name that you want to use for your Office Live Small Business account, you can transfer that domain to Office Live Small Business. Office Live Small Business will register your domain name through Melbourne IT.

On the Office Live Small Business Home page, click More and then click Domain Manager.
On the left navigation bar, click Domain Manager.
Click Purchase additional domains.
In the Domain name box, type the domain name that you want to use, select the domain suffix (for example, .com, .org, or .net) from the list, and then click Check availability.

Note: The annual cost of registering a new domain name is listed on this page, next to the Domain name box.
If the domain name is not available, you are asked to choose a different domain name. Type a different domain name or choose a different suffix, and then click Check availability.
If the domain name is available, make sure it is spelled the way you want to appear, and then click Confirm.

Important:

If you want your new domain name to be the main domain that customers use, you must set it to be your primary domain You can register additional domain names to send traffic to your primary domain.
Each Office Live Small Business account is associated with one Web site. If you want to create a second Web site that is not related to the first, you must create a second Office Live Small Business account.

Tips for choosing your domain

Choose a short, memorable domain name. It is easier for your customers to recall, and is easier to display on your logos, business cards, and billboards.
When selecting your domain name, choose one or two words that are easy to spell. Also, before registering your domain name, make sure that the spelling is correct and that the domain name you specified is what you want.
Try to avoid using numbers and hyphens in your domain name. If you register the name "my-company23.com," you will have to tell people that your domain name is "my hyphen company twenty-three dot com." It is easier for people to remember your domain name if it is short and simple.
Choose a domain name that relates to your business or organization. Choosing a name that is related to your business makes it easier for your Web site visitors to remember the URL.
The domain name can contain only letters, numbers, and hyphens; it must consist of 3 to 40 characters, and begin and end with a number or letter. Spaces are not allowed.
When you are securing or buying domain names, you may want to buy more than one. Consider buying a name with the keywords that capture type-in traffic. Type-in traffic refers to users who reach sites by typing keywords into the address bar of their Web browser instead of using a keyword search on a search engine. Also consider buying the domain names that are variations of your Web site domain name or are a misspelled version of it. You can redirect users to your site with these additional names.

How to change your Windows ID.

Has your domain expired and with it your owner access to your OL account? Many formerly free domains will expire over the next few months-and with them so will many custom email addresses. If you used a custom email address linked to your domain as your Live ID when you set up your account (ie me@mysite.com), you will see a scary "your id is invalid" message when you attempt to log in and no indication of why. If you set up a secondary user, you will be able to log in to your account but won't have access to owner features.

You may have read in the community forum that you CAN'T change your Live ID and while normally that might be true, the good news is if this has happened to you, it's easy to change your Live ID and restore complete access to your account.

Go to http://account.live.com. Enter your old id/password. You will be told your id is invalid and asked if you want to set a new id. Follow the prompts to set up the new id. After verifying your new id via an emailed link, you will now be able to log in to your account with full owner privileges!

How To Get Backlinks To Your Website

When it comes to the game of ranking high in the search
engines, nothing is more important than getting backlinks
to your website.

Why? Because the search engines see backlinks to your
site as a vote on its relevancy. The more backlinks
you have, the better the content on that page must be,
right?

However, a very common mistake most people trying their
hand at search engine optimization make is thinking that
having a lot of backlinks to their page will help it to
rank.

In some cases, that's true. But you also have to take
into account HOW your page is linked to, not just how
many times.

See, the search engines look at the text within the
hyperlinks pointing back to your site to determine
relevancy. You could have a billion links pointing
back to you that say "Click Here!" but that will not
help you rank for the keyword "Blue Widgets."

To get the most out of your backlinks, you have to be
able to control the hyperlink text in them.

Now, most people will go around trying to exchange
links with other websites, asking people to kindly
link to them using a certain keyword phrase.

But serious search engine marketers don't waste their
time with that, because its too hard dealing with other
people.

If you want to get backlinks to your website, you need
to MAKE THEM YOURSELF! This way, you can control the
hypertext in them, and make sure they point to the
appropriate page on your website.

However, making your own backlinks isn't as easy as
it might sound. The search engines know that people
will try to artificially increase their rankings by
doing this type of thing, so they have some tricks to
figure out who is link spamming and who isn't.

If you're caught link spamming, that may actually hurt
your ranking! So do yourself a favor and don't try to
take a shortcut by plastering your links everywhere.

Instead, think strategically.

Use web 2.0 properties that use RSS feeds. They're
usually free to use, so you can open up an account,
create a free page with your backlinks on it, and then
ping the RSS feed to get the search engines to visit
it and see the backlink you created.

Making a lot of these will help build up your backlinks.

Then, there's social bookmarking. Now remember, you
don't bookmark your pages to get traffic to them from
the bookmarking website, you bookmark your page to get
credit for an authority site like the social bookmarking
site linking back to you using your desired keyword!

All social bookmarking sites have RSS feeds, so when
you bookmark your page, be sure to ping the RSS feed
so the search engines know to check it out.

Finally, one of the best ways to get backlinks is to
have a link page on every website you own, and interlink
your sites!

Its easy to do, and effective. The more sites you
create, the more backlinks you can give to each site.

There are lots of tricks you can use to get many quality
backlinks to your website. If you want to learn them

Domain name glossary

A record (address record)
A type of resource record in the Domain Name System that associates a specific IP (numerical) address with a domain name. This is the record that contains the information that connects your domain name to your actual Web site content when people type your domain name into a browser.

CNAME record (canonical name record)
A type of resource record in the Domain Name System that associates a computer's true ("canonical") name with any alias names also used by the computer. Some domain registrars use CNAME records to redirect or redelegate domain names. Microsoft Office Live Small Business does not use the CNAME record for this purpose, and you will not need to edit this record to redirect your domain to Office Live Small Business.

domain name
An address of a network connection that identifies the owner of that address in a hierarchical format, server.organization.type. For example, in www.adatum.com, the World Wide Web (www) is the server; adatum is the organization, or second-level domain; and .com is the type, or top-level domain (in this case, a company).

domain name registrar
The owner of the customer relationship with customers who buy second-level domains. There may be many registrars for a single top-level domain. Some examples of domain name registrars are GoDaddy, Register.com, and Melbourne IT.

Registrars maintain detailed customer information in their databases, such as the customer's contact address, telephone number, and e-mail address. Customers usually manage their second-level domains at the registrar's Web site, and the registrar updates the registry database when necessary (for example, when a customer renews a domain name).

domain name registry
The registry that controls a top-level domain. For example, Verisign is the registry for the .com and .net top-level domains, and the Public Interest Registry (PIR) is the registry for .org. The registry does not own the relationship with the customer (a domain name registrar does), although it keeps basic information about second-level domains in its database, such as the domain's registration date, expiration date, "lock" status, registrant, and registrar.

domain name reseller
The entity that resells domain names from a registrar. For example, Office Live Small Business and Yahoo! are resellers who resell domain names provided by the registrar Melbourne IT. As an Office Live Small Business account owner, you may never interact with Melbourne IT unless a domain name issue arises (for example, cancellation of a domain).

Domain name system (DNS)
The hierarchical database system that contains mappings of Internet domain name addresses (such as www.adatum.com) and IP addresses (such as 171.31.255.255). DNS names generally consist of a top-level domain (such as .com, .org, or .net), and a second-level domain (the site name of a business, an organization, or an individual). DNS enables the location of computers and services by user-friendly names, and it also enables the discovery of other information stored in the database.

domain transfer
The process of transferring your domain name registration from one registrar to another. If you already own a domain and you want to use it with your new Office Live Small Business account, you will not transfer your domain, you will redirect it instead.

International Corporation for Assigned Names and Numbers (ICANN)
A a quasi-governmental body that is responsible for policies regarding domain names around the world. ICANN makes decisions regarding domain names, such as which organization will be the registry for a top-level domain.

Internet protocol (IP) address
A globally unique address that is used to identify a computer on the Internet. An IP address consists of four numbers (each of which can be no greater than 255) separated by periods, for example, 172.31.255.255.

mail eXchange (MX) record
A type of resource record in the Domain Name System that associates an e-mail address with an e-mail server. You change an MX record to associate an existing e-mail account from another registrar with Office Live Small Business e-mail servers.

nameserver
A computer that uses a Web site name to route visitors to the actual Web site location. For example, when you type www.adventure-works.com into a browser, a name server uses that name to connect you to the adventure-works.com Web site. Your domain name registrar will have a method by which you can edit your name server settings in order to direct your domain name to Office Live Small Business.

namespace
A naming convention that defines individual objects within a group in a shared computing environment, such as a network. A namespace can be compared to a telephone book, in which each name is unique and resolves to the phone number and address of a particular individual, business, or other entity.

redelegation
The process of telling your current domain name registrar to point your domain name to your new Office Live Small Business Web site. You do this by changing the name server information at your domain name registrar. When you redelegate a domain, your domain name registration remains with your current registrar and you will continue to be responsible for domain name fees and renewal with that organization.

redirection
The process of telling your current domain name registrar to point your domain name to your new Office Live Small Business Web site. You do this by changing the name server information at your domain name registrar. When you redirect a domain, your domain name registration remains with your current registrar and you will continue to be responsible for domain name fees and renewal with that organization. Redirection is also known as redelegation.

second-level domain (SLD)
The part of the domain name that appears before the period separating it from the top-level domain name, for example "contoso" in contoso.com.

top-level domain (TLD)
The suffix part of a domain name that indicates the type of organization that the name refers to, such as .com, .net, or .org. Some TLDs are country-specific and are known as country code top-level domains (ccTLD); for example, .uk is the TLD for a domain name in the United Kingdom.

Web hosting
On the Internet, the practice of providing computer and communication facilities to businesses or individuals, especially for use in creating Web and electronic commerce sites. A Web host provides such services as news, mail, or data to computers that connect to it. A Web host can provide high-speed access to the Internet, redundant power and data storage, and 24-hour maintenance at a lower cost than implementing the same services independently.

WHOIS
An online utility that can be used to find out the owner of a second-level domain name. The WHOIS registry provides only minimal information about the domain name stored in the registry's database, while the registrar WHOIS Information provides customer contact information.

So you want to add page transitions to your Office Live Small Business website huh? Keep in mind that transition effects are only supported by Internet Explorer; and many effects are only supported by IE5 and later.

You can use Contact Manager to organize your customers, business relations, sales opportunities, and products or services into five broad lists:

Business Contacts People with whom you have a business relationship. Business contacts appear in a preview pane for easy access.
Personal Contacts People with whom you have a personal relationship. This list only appears in Contact Manager if you have a Windows Live Hotmail account. Items in this list are stored in the Contacts folder in your Windows Live Hotmail account.
Companies Organizations with which you do business.
Opportunities Potential sales opportunities. An opportunity must be associated with either a company or a contact.
Products Merchandise or services that your business sells or provides. You can add products to the Products list in Contact Manager to develop a centralized catalog. Or, you can associate a product with an opportunity if you want to track the product for that opportunity alone.

Add or edit a list item using a form

Each item in the Business Contacts, Companies, Opportunities, and Products lists stores information in a Web-based form. A form provides text boxes for you to type general information and relevant business details, as well as a place to attach notes or phone logs. You can add and modify an individual list item using a form.

On the left navigation bar, click Contact Manager, and then click Business Contacts, Companies, Opportunities, or Products. On the actions bar, click New, and then click the type of item you would like to add.
In the form that appears, type information about the item in the form text boxes, and then click Save.

The new item appears in its associated list, with details from the form displayed prominently. For example, when you add an item to the Companies list, details including company name, location, and phone number appear prominently in the Companies list. This at-a-glance display makes it easy for you to keep tabs on your company contacts. On the left navigation bar, click Contact Manager, and then click Business Contacts, Companies, Opportunities, or Products. Select an item from the list.

Add or edit a list item using a datasheet

You can add or change multiple items in a Business Contacts, Companies, Opportunities, or Products list using a datasheet, a format that looks like a spreadsheet or table. A datasheet makes it simple to update, for example, all of your product items with the details of a new pricing structure.

Note: You can quickly add a contact by typing the contact information in the Add Contact box, and then clicking OK.

On the left navigation bar, click Contact Manager, and then click Business Contacts, Companies, Opportunities, or Products.
On the actions bar, click Actions, and then click Edit in Datasheet.
In the datasheet, click any cell and type your information. If an arrow appears when you click a cell, click the arrow and make a selection from the list.

Associate list items

Once you add an item to a list in Contact Manager, you can create the following relationships between items in different lists:

Associate a contact with a company
Associate an opportunity with a contact or company
Associate a product with an opportunity

These associations can help you keep related business details at your fingertips, without having to search different lists.

Associate a contact with a company

On the left navigation bar, click Contact Manager, and then click Companies.
Click a company that you want to edit. On the actions bar, click Edit Item. You can also click the arrow next to the company that you want to edit, and then click Edit Item.
In the Edit Company form, under Business Contacts, click Add new or Add existing.
Do one of the following:
- If you chose to add a new contact, in the Contacts-New Item form, type contact details into the form boxes, and then click Save.
- If you chose to add an existing contact, in the Add Existing Contact form, select the check box for the contact that you want to add, and then click Save.
- On the Edit Company form, click Save.

Associate an opportunity with a contact or company

On the left navigation bar, click Contact Manager, and then click Opportunities.
Click an opportunity that you want to associate. On the actions bar, click Edit Item. You can also click the arrow next to the opportunity that you want to associate, and then click Edit Item.
In the Edit Opportunity form, next to Opportunity for, select either Company or Contact. In the drop-down list, select the contact or company that you want to associate with the opportunity. Click Save.

Associate a product with an opportunity

If you add a new product to an opportunity, the product is associated with that opportunity alone, and does not appear in the Products list.

If you add an existing product from the Product list to an opportunity, you create a copy of the product in the opportunity. Any changes that you make to the product from within that opportunity are specific to the opportunity. Those changes do not automatically appear in the Products list.

To associate a product with an opportunity:

On the left navigation bar, click Contact Manager, and then click Opportunities.
Click an opportunity that you want to edit. On the actions bar, click Edit item. You can also click the arrow next to the opportunity that you want to edit, and then click Edit Item.
In the Edit Opportunity form, under Products, do one of the following:
- In the Opportunity Product-New Item form, type information about the product in the form text boxes, and then click Save.
- Click Add existing product. In the Add Existing Product dialog box, select the check box for the product that you want to add, and then click Save.
In the Edit Opportunity form, click Save.

Add business notes or phone logs to a list item

You can also add notes and phone logs to a contact, company, or opportunity to make sure your business records remain up to date.

On the left navigation bar, click Contact Manager, and then click Business Contacts, Companies, Opportunities, or Products.
Click the item that you want to edit. On the actions bar, click Edit Item.
In the form, under Activity, click either Add phone log or Add business note.
Type the information you want in the form text boxes, and then click Save.

Delete list items

If you no longer want to track an item in a list, you can delete it. But, before you delete an item, keep in mind these rules:

If you delete a contact or company, you will also delete all the records associated with the item, such as opportunities, notes, and phone logs. If you want to continue to track an opportunity associated with the item you want to delete, you must associate the opportunity with a different contact or company before you delete the item.
If you added a contact to a company that you subsequently delete, the contact will remain in the Contacts list after you delete the company.
Deleting an opportunity will delete the opportunity from the company or contact that it is associated with, and will delete all of the records in the opportunity, such as notes and phone logs.
Deleting a product from an opportunity deletes only that copy of the product. If the product also appears in the Products list, it will remain in that list.

To delete a list item, do the following:

On the left navigation bar, click Contact Manager, and then click Business Contacts, Companies, Opportunities, or Products.
Click the item that you want to delete. On the actions bar, click Delete Item.
When prompted, click OK.

Manage projects better with a private online workspace

For a busy small-business owner, creating and maintaining a Web site is often a big step. So the idea of also building a "private" online workspace for the purpose of sharing information with employees and partners might seem like a technological pipedream.

But Web workspaces that exist just for internal use—and beyond the reach of everyday Internet users—are not outside the realm of smaller companies any longer. Those "intranet" and "extranet" sites typically associated with large businesses, a room packed with Web servers and full time IT staffs, are now available as an online service.

Microsoft Office Live Small Business is a good example. This online service includes three specially-equipped workspaces, plus a separate workspace feature called Office Live Workspace. A workspace is a distinct online site where you can privately store and share documents, project details and timelines, and more with others either inside or outside your company, or both inside and outside your company.

"If a small business is looking for a quick turnkey solution, then Microsoft Office Live [Small Business] is fast and easy with nothing to install," says Ramon Ray, editor of Smallbiztechnology.com, a site that helps small to medium-sized businesses use technology to grow.

'It’s still kind of new'

Because the opportunity to use private sites is just becoming available and affordable to small businesses, technology consultant Jason Harrison (www.harrisontechconsulting.com) says he often needs to explain the benefits to his clients.

"For a lot of small businesses, it's still kind of new," Harrison says. "But it really makes sense for certain projects that require collaboration especially for businesses whose clients are dispersed."

Indeed, one of the key benefits of private sites is that they enable users to log on to a password-protected site to gain access to information—from anywhere at anytime using the Windows Internet Explorer browser.

Private sites offer other benefits too. With these types of sites you can:

Let employees quickly find and view information related to their roles and job.
Allow employees and partners to "pull" information as needed rather than be swamped with e-mails.
Create a company communication channel where you can post company policies, procedures, weekly reports, and memos to keep everybody on the same page.
Reduce the need for meetings by allowing project information to be viewed by business partners, customers, and suppliers.
Give approved site users access to the most accurate and up-to-date information.

Harrison sees private sites as particularly suited for professional organizations like architects, attorneys and others who must exchange and review a lot of information.

Business workspaces in three flavors

Office Live Small Business anticipates many of the ways a small business might use private workspaces. So it provides specially-equipped workspaces in three pre-built flavors.

Customer Workspace. This Workspace template lets you set up a separate site for each of your active clients. Built-in features allow you to share project details, timelines, documents, and more in a password-protected environment. Customer Workspace contains a variety of features, including lists, libraries, and Web pages.
Team Workspace. This Workspace is for internal teams and has tools to quickly organize, author, and share information and comes with a document library, and lists for managing announcements, calendar items, tasks, and discussions. Customer Workspace contains a variety of features, including lists, libraries, and Web pages.
Document Manager. Use Document Manager to store, share, and monitor the versions of your business documents in a central location.

Features in Office Live Workspace

Office Live Workspace allows Office Live Small Business users the ability to store and share documents online for free. Permitted users can access the documents from home, work, or traveling—no need for flash drives or e-mailing documents to yourself.

Access files from anywhere. With Office Live Workspace, you get 5 GB of free online storage and easy-to-create folders. You can organize all of your business and other documents in one place and access them via a Web browser.
Share and collaborate easily. Your workspace is password-protected, which means you can control who can view or edit your documents—whether it be co-workers, partners, even customers.
Work with programs you know. You can open and save documents with familiar programs such as Microsoft Word, Excel, and PowerPoint.

A workspace for you and your accountant

One example from Office Live Small Business is a workspace that allows you to better connect with your accountant or financial manager. This workspace lets you post financial information created in Microsoft Office Accounting Express 2009—a free download—and in other documents so your accountant can access them. This saves you the trouble of having to manually send accounting backup files as a large e-mail attachment or via postal mail on a CD.

Office Live Workspace protects financial data transmitted from this workspace, as it does with all Office Live applications, by use of the HTTP Secure protocol rather than standard HTTP. Moreover, access to all Office Live workspaces and information contained in them is controlled by assigning user permissions.

Harrison observes that small businesses are more nimble than their bigger counterparts and, as a result, can embrace technologies such as online private workspaces more quickly. So he encourages them to experiment and reap the benefits if they can.

"I tell clients, 'Don't sit back and ignore these kinds of opportunities to be creative with how you operate your business.'"

Last word: Confused about the terms "intranet" and "extranet"? Here's the difference:

An intranet is a private or internal Web site used only within one company.
An extranet is an internal or private Web site used within a company, but access privileges are extended to customers, partners, and others you designate.

Change the page layout

When you create a Web page, you can choose a page template other than the default layout. However, after the page has been created, you may find that you want to change the page's layout. You can quickly change the way your content appears on your page by selecting a different layout.

Five page layouts are included in Page Editor:

Single area This layout consists of one large content zone.
Two, side by side This layout has two equally sized vertical content zones.
Three, side by side This layout has three equally sized vertical content zones.
Three, span bottom This layout has two equally sized vertical content zones placed above one large content zone.
Three, span top This layout has one large content zone placed above two equally sized vertical content zones.

Note: When you save your changes, all modifications are published to your Web site immediately.

Change your page layout

On the Home page, on the left navigation bar, click Web Site.
In Page Manager, next to the page that you want to modify, click Edit.
In Page Editor, click Layout, and then select a layout.

Note: To preview a layout's appearance, click the layout. You must save your changes before you can view them on your public-facing Web site.

Spell-Checking an Office Live Web Page

There have been numerous requests for Office Live Small Business to include a spelling checker among the Page Editor tools. Lacking that, some alternatives have been suggested. These include composing text in a word processor and spell-checking it there. Inspyder Insite is third party web page spelling checker I have used, and it works very well.

Today, I discovered another option, so I thought I would post a short wiki to share it. I discovered that the Google toolbar spelling checker now works in the Office Live Page Editor. I had tried this in the past without success, but now it seems to work. Open the page for editing and click on the toolbar icon. Misspellings become red and underlined. Click on the word for suggestions, then select the correct word to replace it. The GTb speller also works for posts here in the Office Live Community.

While checking a page, the speller will occasionally close itself. Click the icon again to restart it. Also, pages with HTML modules don't seem to work well with the speller. When activating it, the code in the modules re-executes, and that seems to shut down the speller.

I used the speller on two different sites, one an old beta site, the other a brand new one. I was running Internet Explorer 7 in Vista HP. There are some questions that still need to be answered:

Will other toolbar spellers also work?
Will they work in other operating systems?
Will they work in other browsers and versions?

that only the people most likely to buy are searching for.

This way, not only will you rank quickly, but you'll
also be getting highly targeted traffic that's most
likely to make you money.

For example, instead of trying to rank in the top 10 search
results for the competitive keyword "Plasma TV," you would
want to focus on a keyword like "Sony RX1568 Plasma TV."

This way, you'll be able to rank for a term only people
looking to buy that particular TV would be searching for!
